Do You Have a Lemon?
Do you have a new car or truck which spends more time parked at the dealership waiting for repairs than in your own driveway? If so, you may have been sold a lemon. In West Virginia, consumers like you are fortunate to have the benefit and protection of the West Virginia Lemon Law. The West Virginia Lemon Law provides that if your vehicle is under a manufacturer's warranty (whether new, used or a program car) and the manufacturer's approved dealer is unable to fix your problems, you may be entitled to several remedies.
If you can show that your vehicle has a problem which substantially impairs the use or market value of the vehicle, then the manufacturer must replace your vehicle with a comparable new vehicle, or refund your money. The West Virginia Lemon Law also provides that the manufacturer shall bear all costs of performance under this law, which ultimately means the manufacturer must also pay your attorney fees and costs over and above all monies paid to you in satisfaction of your claim.
